Law Office of Jacqueline M. Jacobson

Our firm is committed to providing you with quality legal representation to help you get the medical benefits and related compensation you are entitled to through the workers' compensation system.  Coping and recovering from your injury is difficult enough without also trying to navigate the complicated legal framework of Oregon workers compensation law.  This is where we come in.  You can benefit from our experience to help you get the compensation you need to provide for your medical care and related expenses.  We only receive an attorney fee if we get additional benefits for you.

What we can do for you if:

You have a denied claim:

If you receive a denial from the workers' compensation insurance company, you only have 60 days to appeal the denial by requesting the hearing to the Workers' Compensation Board.  Once you request a hearing, you have the burden of proving that your need for medical treatment was caused by your work injury or work activity over time.  We can make sure the appeal is timely filed, and that your case is prepared and presented well at your hearing.  If we are successful, the workers' compensation insurance company pays our attorney fee on top of any benefits owed to you.  If we are unsuccessful, you will not owe us an attorney fee.

You have an accepted claim:

Once your claim is accepted, you have lifetime medical benefits related to the accepted conditions.  However, claims are commonly accepted for the initial condition diagnosed, and not amended to include a diagnosis your doctor may make later on.  We can review your claim to ensure your work-related conditions are accepted and secure your lifetime medical benefits.

If you have missed time from work authorized by your doctor related to your work injury or disease, you are entitled to 2/3 your average weekly wage until you are released to return to work.  If you are not receiving time loss or not receiving time loss at the right rate, we can help you take appropriate action to contest the insurer's calculations as necessary.

Your claim has been closed:

The workers' compensation insurer can close your claim when your doctor thinks you are medically stationary.  If you have any permanent impairment, you should receive a permanent disability award.  If you can not return to your job at injury, you may be entitled to vocational retraining.  We can help you by reviewing the insurer's closure and making sure that you receive the benefits to which you are entitled.
